MGN 408 (M+F): The Merchant Shipping and Fishing Vessels (Health and Safety at Work) (Biological Agents) Regulations 2010
Guidance on the Merchant Shipping and Fishing Vessels (Health and Safety at Work) (Biological Agents) Regulations 2010. Biological agents are potentially harmful micro-organisms, and these regulations require employers to take account of the risk to workers of exposure to such agents when carrying out health and safety risk assessments. This could have an impact on some UK yachts, particularly in relation to biological sewage treatment plants.

MGN 409 (M+F): The Merchant Shipping and Fishing Vessels (Health and Safety at Work) (Chemical Agents) Regulations 2010
Guidance on the Merchant Shipping and Fishing Vessels (Health and Safety at Work) (Chemical Agents) Regulations 2010. These regulations require employers to take account of the risks to workers of exposure to chemical agents when carrying out health and safety risk assessments. This will have an impact on most UK yachts, as chemical agent means ‘any chemical element or compound with the potential to cause harm if inhaled, ingested or by coming into contact with or absorbed through the skin and could potentially include chemical substances such as paints, cleaning materials, fumigants and pesticides...’.

MGN 410 (M+F): The Merchant Shipping and Fishing Vessels (Health and Safety at Work) (Work at Height) Regulations 2010
Guidance on the requirements of the Merchant Shipping and Fishing Vessels (Work at Height) Regulations 2010. Falls whilst working at height can potentially result in serious or even fatal injuries, and these regulations require employers to take account of the risks associated with working at height when carrying out health and safety risk assessments. This will apply to yachts, especially those on which crew members scale the sailing rig, radar mast or use a Bosun’s Chair whilst cleaning windows, for example.

MIN 378 (M+F): M-Notices - pricing and availability information
Guidance on how to obtain copies of the UK’s M-Notices. Whilst Flag News is not listed as an official source of MGNs, MSNs and MINs, it can be used to comply with aspects of SOLAS V Regulation 27 if electronic or hardcopies of the newsletters and the M-Notices relevant to the yacht are retained onboard.

MIN 380 (M): New Port State Control Directive
Notification of the forthcoming implementation of the new Port State Control directive into UK law from the 1st January 2011, and an explanation of the changes to the Port State Control regime. This information is relevant to any yachts operating in the waters of any of the 27 member states of the Paris MOU Region (www.parismou.org), which includes France, Italy, Spain and the UK.

MIN 381 (M+F): Research Project 616 Lifejacket Wear - Behavioural Change
To accomplish the set target of increasing carriage and wear rates of recreational boater in the UK, a research project was undertaken to find out which people on recreational craft are not carrying and wearing lifejackets, and the best way to encourage a change their behaviour. The project completed in November 2009 and the results are now available here. Whilst not directly related to large yachts, the report's results could make interesting reading for their crew and managers.

Shipping Guidance Notice 015: Carriage of nautical publications
Recognition by the Gibraltar Maritime Administration that the UKHO’s Total Tide and Admiralty Digital List of Lights software satisfies the requirements of Gibraltar Merchant Shipping legislation and SOLAS Chapter V with regard to the carriage of nautical publications. As many of the UKHO’s publications are now available electronically, and due to the general lack of space for cumbersome paper documents on most yachts, this could be of interest to Deck Officers on yachts of all flags and sizes.

MARSHALL ISLANDS

Marine Notice 2-13-9: Vessel Response Plans and salvage and marine fire-fighting capability requirements for Tank Vessels operating in US waters
A reminder for owners/operators of Marshall Islands tank vessels operating in US waters that 22 February 2011 is the revised date by which a VRP must include the relevant USCG salvage and marine fire-fighting requirements. Whilst this should not affect MI-registered yachts, it may affect MI-registered shadow boats that carry large quantities of oils.

Marine Notice 2-11-33: Maritime Labour Convention, 2006 - inspection and certification program
Additional information on the initial then ongoing implementation of the MLC 2006 by the Marshall Islands Administration. This is applicable to MI-registered yachts (private and commercial), but may also be of interest to persons involved with the operation of yachts of flags that have not yet ratified the convention (e.g. UK, Bermuda, Cayman Islands, Isle of Man, etc.).

Marine Notice 2-11-34: Special Purpose Ships
Information on the MI’s clarifications to, and interpretations of, the IMO’s Code of Safety for Special Purpose Ships, 2008. This code does not apply to yachts.

Marine Notice 2-11-35: National safety requirements for Offshore Supply Vessels
Information on the MI Administration’s equivalent requirements for OSV’s, acknowledging that whilst SOLAS’s Passenger Ship requirements strictly apply to those vessels carrying more than 12 offshore workers, the training of the workers and typical areas of operation make the SOLAS requirements inappropriate. These equivalent requirements do not apply to yachts.

Marine Notice 2-11-36: National safety requirements for vessels carrying persons in addition to crew
Clarification from the MI Administration on their requirements for vessels carrying more than 12 persons who are not crew members. This information is applicable to those MI commercial yachts that carry more than 12 guests and supernumeraries (security personnel, medical personnel, pilots, etc.).

Marine Notice 7-41-3: Pilot transfer arrangements
Information to ensure that pilot ladders, mechanical pilot hoists and their arrangements, use and maintenance conform to standards not inferior to those set out in IMO Resolution A.889(21). This will apply to those yachts that have occasion to use the services of a pilot in entering or leaving port, or wherever pilotage is required.

Marine Notice 7-43-1: Means of ship embarkation / disembarkation
Information on the implementation of SOLAS Regulation II-1/3-9, which entered into force on 1 January 2010. It establishes construction, installation, maintenance, and inspection requirements for the means of embarkation on and disembarkation from ships. This regulation should apply to commercial yachts over 500GT, unless the Commercial Yacht Code is revised to include equivalent requirements. The regulation should also apply to commercial yachts of other flags above 500GT.

Circular GEN 011: Guidelines for the certification of crew boats
Guidelines to identify the technical requirements and certification procedure applicable crew boats of less than 500 GT engaged in international service. These guidelines do not apply to yachts.
